Is Selling a Used Mattress Illegal?

Individuals or retail establishments selling secondhand mattresses or mattresses containing used materials are not breaking the law. Only the labelling of mattresses made with used filling is required by federal law.

Many states do not have legislation governing the labelling of used mattresses, the sanitising procedure they must go through, or which pieces may be retrieved from old mattresses to be used in the construction of new ones. In fact, some bedding is available for purchase without any sort of label. As a result, it is the consumer’s responsibility to become knowledgeable about state laws and to purchase properly labelled mattresses from reliable suppliers.
